Welcome to Oceana Medical LLC. These Terms of Service ("Terms") govern your use of our visual guidance device, PaceAid, and related services ("Service"). Please read these Terms carefully before using PaceAid. By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
All claims regarding PaceAid’s effectiveness are based on validated data and scientific evidence. Marketing materials, website content, and communications will not contain misleading or unsubstantiated statements and are guided by FTC standards.
By using PaceAid, you agree to comply with and are legally bound by these Terms, our Privacy Policy, and any additional policies or guidelines we may publish.
2. Description of Service
PaceAid is intended solely as a supportive visual guidance aid for CPR. It does not diagnose, treat, or prevent any medical condition, and is not a substitute for professional medical advice, training, or emergency services. Use only as directed and in accordance with all instructions.
3. User Responsibilities
- Use PaceAid solely for its intended purpose in assisting in CPR performance.
- Users must follow all instructions and safety guidelines provided with PaceAid. Do not modify, misuse,
or operate the device outside its intended purpose. Any deviation from the instructions provided may
increase risk and void regulatory compliance.
- Do not use the product in a manner that may harm yourself or others.
- Seek professional medical help immediately in an emergency; PaceAid is a supportive tool and does
not replace professional medical advice or training.
- Do not use PaceAid if you have any medical conditions that may be affected by its use without
consulting a healthcare professional.
4. Privacy and Data Collection
By using PaceAid, you consent to our Privacy Policy, which explains how we collect, use, and protect your information. We may collect location data and usage data to improve the accuracy and effectiveness of the service. Your data will be handled securely and in accordance with applicable laws.

8. Medical Device Reporting (MDR)
If you experience any malfunction, adverse event, or unexpected operation of PaceAid, please report it immediately to our support team at info@paceaid.com or call 1 (732) 631-4060. We will investigate and, if required, report to regulatory authorities in accordance with FDA Medical Device Reporting requirements.
9. Post Market Surveillance
PaceAid continuously monitors device performance and user feedback to identify and address potential safety issues. Updates to instructions, warnings, or device features will be communicated to users as needed.
10. Limitation of Liability
To the maximum extent permitted by law, PaceAid and its affiliates, licensors, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service, including injury, death, or property damage, even if advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless PaceAid, its affiliates, officers, directors, employees, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any applicable law or third-party rights.
12. Termination

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PaceAid is operated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the courts located within that jurisdiction.

FDA registration means the manufacturer has provided required information to the FDA, but the FDA has not reviewed or approved this product for safety or efficacy.
